Richard Howell, Litigation Associate Director, supported by Regina Meleji, Commercial Litigation Paralegal instructed Greg Leckey of No 5 Chambers bringing a claim on behalf of the trustees of an unincorporated association, which was successful in establishing that the Defendants, who were occupying several buildings held on trust for the unincorporated association, were trespassers. After a 5-day trial at Birmingham County Court possession order was granted and an injunction to prohibit the Defendants from further entering the premises. The Defendants had formerly been engaged in long-term negotiations with the unincorporated association for the grant of a 99-year lease of the premises. However, their claims that they had a right to occupy the land by virtue of an equitable lease, or, alternatively, that they had acquired rights via proprietary estoppel, were dismissed by the Court. The Court found that the key terms of the draft leases between the parties were under negotiation and, therefore, no equitable lease arose. As for the estoppel claim, the Court ultimately found there to have been no promise or assurance made by the unincorporated association that an interest in the land would, in fact, be granted.
